Commercial Use – If the course or course materials, which were developed by a faculty member for a distance learning course for which the faculty or professional staff received remuneration for the adaptation, generate commercial value, the net proceeds (net of marketing, marketing, attorneys` fees or other associated fees) are divided between the college and the developer(s) developer(s) of that property, with the college keeping 50% and the developer 50%, unless the college and developer have negotiated otherwise. This agreement is between the Board of Directors of Higher Education (hereinafter the employers) and the Massachusetts Teachers Association/Massachusetts Community College Council (hereinafter the Association). In this Agreement, the Parties intend to indicate the impact of distance learning and training on the daily bargaining units and DCE-MTA/MCCC and how the collective agreements of each unit are to be interpreted in the way they apply to distance learning courses. All provisions of the respective collective agreements shall remain applicable in accordance with their provisions, unless amended therein. Course adaptation – The preparation of course materials has always been and always is part of the contractual and professional responsibility of a faculty member responsible for teaching. An on-premises contract is a contract that is not a distance contract or a contract concluded outside the commercial premises. The 2013 rules require the provision of information to consumers in relation to an on-premises contract. All teachers in distance programs must submit a student interaction plan to their department dean before the start of the semester. Distance course teachers are required to provide students with contact information (consultation times, if applicable, telephone number, postal address and/or e-mail).
The participation of the faculty in distance learning is voluntary. The decision of a faculty member not to participate in distance learning is not considered negative. At the end of each semester, a list of all unit and non-entity staff members who have completed distance training or university courses will be made available to the Committee, together with the amount of remuneration in all forms received for each course. DCE course allowance – Distance learning contracts are remunerated in accordance with the rate set by the DCE collective agreement.
